• Agreement to Terms: By accessing or using the 'Anchor Track' mobile application ('App'), you agree to be bound by these Terms of Use ('Terms'). If you do not agree to these Terms, do not use the App.
• License: You are granted a non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial purposes strictly in accordance with these Terms.
• Use of the App: Anchor Track is designed to serve as an additional resource to assist users with anchoring procedures. While we endeavor to ensure precision and reliability, please be advised that the app is to be utilized as a supplementary instrument, not as a replacement for professional navigational systems. As a user, you carry the ultimate responsibility for all decisions and measures taken during the process of anchoring. We urge you to practice vigilant seamanship, guaranteeing that all anchoring operations are executed with meticulous care, aligned with the prevailing best practices, and in adherence to the safety regulations set forth by maritime authorities. Safety should always take precedence. The app is meant to complement, not supplant, your personal judgement and expertise. Employ Anchor Track judiciously and at your own discretion to promote a more secure boating environment for everyone on board.
• Ownership and Intellectual Property: The App and its materials, including but not limited to visual interfaces, graphics, design, data, computer code (including source code and object code), products, software, services, and all other elements of the App ("Materials") are owned by the App provider or its licensors and are protected by intellectual property laws. Any reproduction, modification, or distribution of the Materials is strictly prohibited without prior written consent.
• Disclaimers and Limitation of Liability: Anchor Track serves as a supplementary aid for secure anchoring, designed to enhance, not replace, your existing navigation and safety measures. The app is intended for informational purposes only and is to be used as a companion tool alongside professional systems. The user assumes full responsibility for the use of the app and any anchoring decisions made. Under no circumstances shall the developer be held liable for any direct, indirect, incidental, special, or consequential damages arising out of the use or inability to use the app, including but not limited to the accuracy or reliability of the data provided by the app. By using Anchor Track, you acknowledge and agree to anchor at your own risk, and you agree to not hold the developer liable for any outcomes that may occur as a result of using the app.
• Third-Party Assets and Acknowledgements:Anchor Track enhances its interface with high-quality visual elements thanks to the icons generously provided by Icons8 (https://icons8.com). We have also enriched the user experience with sound effects sourced from Mixkit (https://mixkit.co), where we have selected alarm sounds to alert users effectively within the app.
• Governing Law: These Terms are governed by the laws and jurisdiction of the country/region where the App provider operates. Any disputes arising from these Terms or the use of the App shall be resolved in this jurisdiction.
• Subscription Services: Anchor Track provides an array of subscription options, including monthly, and yearly plans, which are processed through Apple's StoreKit service. 1 month ($2.99) and 1 year ($9.99) durations. Your subscription will be charged to your iTunes account at confirmation of purchase and will automatically renew (at the duration selected) unless auto-renew is turned off at least 24 hours before the end of the current period.
